1. Acceptance of these terms
These Terms of Use ("Terms") govern your access to and use of MHP Compass, including the Radar, Gauge and Red Flags tools, any report or PDF generated by them, and any paid product offered alongside them (together, the "Service"). By using the Service, requesting an analysis, or checking the acknowledgment box presented before an analysis runs, you agree to these Terms. If you do not agree, do not use the Service.
The Service is provided by MHPCompass.com ("we," "us"). If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
2. What the Service is
MHP Compass helps you screen a mobile home park using public records and, where you supply it, your own figures. Depending on the tool, that includes:
- Radar — surfaces an owner and an outreach priority from public record. It is not a prediction of the owner's intent and does not clear you to call; calling rules (TCPA, do-not-call, recording consent) are your responsibility.
- Gauge — scores potential value-creation levers from public listings and figures you provide. It is not a valuation or an appraisal.
- Red Flags — checks flood, wetlands, terrain, water, wastewater, and state and local regulatory records where coverage exists, and produces a preliminary risk screening.
Every report states, item by item, what was resolved from a public source, what was inferred, and what remains unresolved. An unresolved item is an open question, not a favorable finding.
3. What the Service is not
The Service is a preliminary acquisition-screening aid. It is not, and does not provide:
- Comprehensive due diligence, or a guarantee that every issue affecting a property has been identified;
- Legal, engineering, environmental, financial, accounting or tax advice;
- An appraisal, valuation, or property inspection;
- A title examination or confirmation of legal use, zoning or utility ownership;
- Regulatory approval or a determination that a property complies with any law; or
- An investment recommendation.
Absence of an identified issue in a report means the sources that report checked did not surface one — it does not mean the property is compliant, safe, or free of the issue.
4. Data limitations
Reports are built from public records and third-party sources we do not control. Those sources can be incomplete, delayed, outdated, incorrect, unavailable for a given jurisdiction, or subject to matching and mapping errors (for example, an address or parcel resolving to the wrong record). Automated extraction and scoring can also make mistakes. Regulations change, and a report reflects the record as it existed when the report ran, not necessarily the current rule.
5. Your responsibility to verify
You remain responsible for your own decision. Before relying on a report, you should independently:
- Verify material findings against the primary source;
- Obtain and review the seller's own documents;
- Confirm zoning, legal use and utility ownership directly with the responsible agency;
- Arrange a physical inspection where appropriate; and
- Engage qualified legal, engineering, environmental or financial professionals as the deal warrants.
The Service is decision support for a preliminary screen. It is not, on its own, a sufficient basis for a final investment, financing or acquisition decision.
6. No warranties
The Service and every report are provided "as is" and "as available," without warranty of any kind, express or implied, including any warranty of accuracy, completeness, timeliness, availability, merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation, to the fullest extent permitted by law.
7. Limitation of liability
To the fullest extent permitted by law, MHPCompass.com will not be liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, lost opportunities, transaction losses, property defects, remediation expenses, financing decisions, or regulatory penalties, arising from your use of the Service.
For a free report, MHPCompass.com's total liability under these Terms is limited to $100. For a paid product, MHPCompass.com's total liability is limited to the fees you paid for that product in the twelve months before the claim arose.
Interim position, set by the founder without counsel's review, effective the version date above. This cap will be revisited once counsel is engaged.
8. Indemnification
You agree to indemnify and hold MHPCompass.com harmless from third-party claims arising out of your misuse of the Service, your violation of these Terms, your unauthorized use of another person's information, or your distribution of a report in a way that represents a preliminary finding as a verified, comprehensive or guaranteed fact. This section does not extend to claims arising from our own fraud, intentional misconduct, or gross negligence, or as otherwise limited by applicable law.
9. Eligibility and acceptable use
You must be at least 18 to use the Service. You agree not to scrape, systematically harvest, or resell report data or the underlying public-record datasets, not to circumvent any rate limit or access control, and not to use the Service to violate any law, including telemarketing and do-not-call rules applicable to any contact information a report surfaces.
10. Paid products
Some products (for example, a human-reviewed diligence pack or deal-desk review) are sold for a fee, shown at checkout before you pay. Payment is processed by a third-party payment processor; we do not store your full card number. Refund and cancellation terms, if any, are stated on the product's order page at the time of purchase.
11. Intellectual property
The Service, its design, scoring methodology and report format are owned by MHPCompass.com or its licensors. You may download and share a report you generated for your own evaluation of that property; you may not alter a report to remove its disclaimers, sourcing or version identifiers before sharing it. A report is prepared solely for the person who requested it. Anyone else who reads a shared copy is not a party to these Terms and should independently verify every finding before relying on it.
12. Changes, suspension and termination
We may change, suspend or discontinue any part of the Service, and may suspend or terminate access for a violation of these Terms, at any time.
13. Governing law and venue
These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws rules. Any dispute not resolved informally will be brought in the state or federal courts located in New Hampshire, and you consent to that venue.
Interim position, set by the founder without counsel's review. It does not include an arbitration clause or a class-action waiver — that choice is reserved for when counsel is engaged, and will be revisited then.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be read to reflect the parties' intent as closely as the law allows.
15. Changes to these Terms
We may update these Terms as the Service changes. A material change will update the version and effective date above. Continued use after a change means you accept the updated Terms.
